Adventure Trans Himalayan Treks & Expeditions’s Trip Waiver, Terms & conditions 

 I have acknowledged this is an adventure trip and thoughtfully sign this form. This is a very important fundamental requirement for some flexibilities. The Itineraries and programs I have taken are only the guidelines. The trip organizer is not responsible for any delays of International or Domestic flights.

Adventure Trans Himalayan Treks & Expeditions Trip Terms and Conditions 30% of Trip Advanced deposit money is required at the trip booking time. Transfer of an advance deposit money to a different trip or date is allowed but all advance deposits are non-refundable within a 70 days start trip window. It is also possible to transfer your deposit to another individual, however, if transferred to another individual the advance deposit money is only good for the trip the advance deposit money was originally made for. The Final Payment is due three (3) months before the trip date. Final payments are non-refundable and non-transferable. If the trip is canceled for any reason, other than ATH office, (including but not limited to: inclement weather, “act of god,” civil war, travel restrictions, etc) no refund will be issued. Trip insurance can be purchased to help cover costs in case of cancellation.

Adventure Trans Himalayan Treks & Expeditions is not responsible for travel to and from the starting destination of the trip. Any issues or additional expenses that occur while traveling to or from the starting and ending destinations will be the responsibility of you, the traveler.

Adventure Trans Himalayan Treks & Expeditions reserves the right to run the trip according to the schedule set in the trip itinerary. If travel delays, visa issues, etc delay you, the traveler, from arriving to the trip starting point on time you will be responsible for any associated costs to join to group. If joining the group is not possible no trip refund will be given.

If for any reason you must leave a trip or cannot continue on the set itinerary no refund will be given. Any additional travel arrangements made to accommodate for a traveler separating from the group (flight, taxi, additional hotel room, etc) will be the financial responsibility of the traveler.

Adventure Trans Himalayan Treks & Expeditions reserves the right to adjust the trip itinerary as necessary.

If sufficient trip numbers are not met three (3) months out from trip date Adventure Trans Himalayan Treks & Expeditions reserves the right to cancel the trip. If a trip is canceled/postponed due to booking numbers a full refund of the balance paid will be offered.

Adventure Trans Himalayan Treks & Expeditions can offer ideas and support on additional activities but bears no responsibility for any additional travel plans or activities. You are solely responsible for these experiences.

Adventure Trans Himalayan Treks & Expeditions is not responsible for any harm that may occur while on any trip. This includes but is not limited to death, dismemberment, other bodily injury, any medical issues, capture, mugging, robbery, etc. By agreeing to these terms and conditions you acknowledge and agree to all points listed above and release Adventure Trans Himalayan Treks & Expeditions and its partners, affiliates, Leaders/guides, Travel Agents, hotels etc. from any/all possible litigation now and in the future.

I acknowledge that there are numerous risks involved in traveling abroad. Traveling at high altitudes, high Passes physical exertion required of Activities and Trekking and living in extreme or uncomfortable situations can aggravate pre-existing physical injuries, conditions, or symptoms. Instruction as to the proper management of health and safety while traveling abroad and at high altitudes is available from Adventure Trans Himalayan Treks & Expeditions staff, Nepali teams and organizers. While traveling or hiking there are risks to be encountered which you should be aware of.

Adventure Trans Himalayan Treks & Expeditions has selected the best transport possible, this being the case, local transport/domestic flights will often not be up to developed country standards. The roads are rough and sometimes non-existent. Driving standards are very different than Western/European standards, but vehicles travel at much lower speeds. Injury from bumpy roads are rare, but possible. Whenever possible Adventure Trans Himalayan Treks & Expeditions minimizes these risks by taking domestic flights. Domestic flights have risks and are often delayed due to bad weather.

While hiking you may traverse rugged terrain: high mountain passes, snow and ice, exposed and rough trails, routes threatened by avalanches and landslides and crossing streams and rivers by rough bridges or slippery rocks. There are risks of falling, rock fall, landslides, collapsing bridges and exposure. There are also potentially dangerous animals, dangerous plants, and dangerous insects. Any wild and domestic animal that you may encounter can be dangerous, including the yaks, monkeys, dogs, and horses that carry your bags on some journeys.

Water should buy a mineral water bottle or be purified, filtered or treated before drinking. This includes ALL tap water in cities, towns and villages, and all stream water. Cleaning your hands before eating and after toilet functions is critical in maintaining good health, as is using hand sanitizer.

Altitude sickness (Acute Mountain Sickness: AMS) is a significant risk. Altitude sickness occurs when your body cannot properly adapt to the lower amounts of oxygen found in the air at high and extreme altitudes. Acclimatization is the process by which the body adapts. Many people suffer some form of mild altitude sickness and most people can acclimatize to high altitudes, but not everyone. The key is to ascend slowly, over a period of days, not to exert yourself, and to drink plenty of water. Altitude sickness can develop into High Altitude Pulmonary Edema (HAPE) and High Altitude Cerebral Edema (HACE), which can be fatal if not treated quickly. Treatment is rapid descent to a lower altitude. Let your facilitator Trip leader and guides know if you have a bad headache, feel dizzy or feel anything out of the ordinary. Failure to do so may result in AMS or other sickness.

I understand that if I want or need to ride a horse, for medical or sightseeing purposes, it is entirely at my own risk, and Adventure Trans Himalayan Treks & Expeditions bears no responsibility for any activity related to horseback riding.

Western,  European -standard hospital care is often not available. While hiking, trekking, Mountaineering and traveling you may be several hours to several weeks from any medical facility. Everyone is required to have their own travel medical insurance including rapid airlifting. Decisions made by the leader/Guide and participants (team members/clients) in a wilderness setting are based on a variety of factors, perceptions, and evaluations which by their nature are imprecise and subject to errors in judgment. Throughout the tour participants are responsible for their own safety and must show consideration for the safety of other members of their group.

This list is not an exhaustive list of possible injuries or accidents that may occur while traveling, hiking, trekking or mountaineering Peak climbing. Most of these injuries are rare and you are not likely to encounter them, however, they may occur and you must be aware of the risks.

I understand that trekking includes physical movements in adventure trips including, but is not limited, As is the case with any physical activity, the risk of injury, even serious or disabling, or death is always present and cannot be entirely eliminated. My signature acknowledges that I understand trekking is a personal practice that exposes me to the possible risk of personal injury - physical, mental or emotional. If I experience any pain or discomfort, I will listen to my body, adjust the posture and ask for support from the leader/Guide. If I feel overexertion or fatigue, I will respect my body’s limitations and I will rest before continuing walking. I acknowledge that it is my responsibility to inform the Leader/guide of any prior injuries, illnesses or health problems. I realize that the treatment is being given for the well-being of my body, mind and spirit. I understand that the leader/guide does not diagnose illness, disease or any physical or mental disorder, nor do they prescribe medical treatment. It is recommended that I see my primary health care provider for exams, diagnosis and treatments. I acknowledge that yoga retreats and therapeutic treatments are complimentary to any medical care. Certain suggestions and healing techniques are not recommended and are not safe under certain medical conditions. I affirm that I alone am responsible to decide whether to continue. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against Adventure Trans Himalayan owners, staff, and Drivers. contractors, leaders/guides or any other employees.

If I am pregnant, become pregnant or am post-natal, my signature verifies that I am participating in traveling and trekking with my doctor’s full approval. I realize that I am participating in all activities at my own risk.

My signature further acknowledges that there are inherent risks associated with being in a remote trekking travel setting. I acknowledge that because of remote locations, access to advanced medical care may be significantly delayed. I acknowledge that it is my choice to participate in any trekking travel or group activity during a trip and I participate at my own risk. Additionally, I realize that I might be exposed to environmental risks and hazards including wildfires, uneven land, fast river currents and dangerous wildlife on a  Trekking trip.

Photo Release

Said release shall further assign to Adventure Trans Himalayan Treks & Expeditions and Kumar/Sanjib have all rights to use photographs and videos of me taken relative to said activities including, but not limited to, use in brochures, website, social media advertisements, posters, movies, marketing materials, and the like.

 

Release of Liability, Waiver of Claims and Indemnity Agreement

I ________________________________ herby agree as follows:

I certify that I am fully capable of participating in a travel, hiking, trekking, mountaineering, Peak climbing and many other activities. I state that I have read the above statement on some of the possible risks. I therefore assume full responsibility for myself for bodily injury, death and loss of personal property and any expenses as a result of accident, my negligence, trail or river conditions, weather conditions, political situations, acts of war, natural disasters or other situations beyond our control. I agree that if I want or need to ride a horse, for medical or sightseeing purposes, it is entirely at my own risk, and I

Adventure Trans Himalayan Treks & Expeditions bears no responsibility for any activity related to horseback riding.

I also understand that the organizer (Adventure Trans Himalayan Treks & Expeditions or partner agencies) reserves the right to refuse any person it judges to be incapable of meeting the rigors and requirements of participating in travel, hiking, Mountaineering Peak climbing or trekking on any given journey. This includes both physical condition and mental stability. I confirm that I am in good physical condition, am in good mental health, have had a FULL medical check-up, and am able to undertake this journey which may involve mountaineering Peak climbing, hiking or trekking. I certify that to my knowledge I do not have any medical or psychological condition that would prevent my participation. I hereby give permission for transportation to any medical facility or hospital and I authorize any facilitator or leader/guide or medical personnel to render emergency medical care for myself.

I and my heirs agree to indemnify and hold harmless the organizer and other participants, from all claims, damages, losses, injuries and expenses arising out of or resulting from my participation in these activities. I further agree to release, acquit and covenant not to sue the organizer and/or other participants for all actions, causes of action, claims or damages, of whatever kind, including the negligence of the organizer and/or other participants, arising out of participation in this program. In short, I cannot prosecute or sue the organizer and/or other participants, and if I do, I cannot collect any money.

The terms of this agreement shall continue and be in effect after the trip/journey has ended. I agree that if the organizer is forced to defend any action, lawsuit or litigation by myself, my executors, or my heirs, on my family’s or my behalf, my heirs or executors and I agree to pay the organizer all costs and legal fees if they successfully defend such action, lawsuit or litigation. This is a legal document. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against Kumar GURUNG, Sanjib GURUNG Adventure Trans Himalayan Treks & Expeditions its Leaders, Guides member, owners, or employees/potters. This waiver is binding on me, my heirs, my spouse, my children, my legal representatives, my successors and my assigns.

My signature is binding to this liability waiver from this day forth.
